These Terms & Conditions (“Terms”) govern your use of Web V8’s web hosting services (“Services”). By using our Services, you agree to be bound by these Terms.

1. Service Description

Web V8 provides shared web hosting plans located in Australia. We offer dedicated servers located overseas upon request, subject to availability and additional fees. All website backups (S3 Storage) are stored in Australia.

2. Data Loss & Backups

Web V8 strives to maintain regular backups of your data. However, we cannot guarantee against data loss. Backups are typically retained for 7 days (or longer depending on disk usage). You are responsible for maintaining your own backups if you require a longer retention period.

3. Content Responsibility

You are solely responsible for the content stored on your Web V8 hosting account. This includes ensuring all content complies with applicable laws and regulations. Web V8 does not take ownership of your content.

4. Prohibited Content

Web V8 prohibits the storage of illegal content, including pirated materials, on our servers. We will handle DMCA requests by contacting you to remove the infringing content. You have 30 days to comply before we take further action.

5. Payment & Suspension

Your account will be suspended for non-payment.

6. Security Measures

Web V8 takes reasonable security measures to protect your data. However, if you choose not to utilize our recommended CloudFlare service, we cannot guarantee the security of your website. Additionally, if your domain name is not registered with Web V8, we cannot guarantee domain-related security.

7. Email Services

Web V8 offers a limited email service. For robust email hosting solutions, please purchase a dedicated email plan or contact us for options.

8. Full Service & Maintenance

Our full-service and maintenance plans are limited to standard WordPress websites without custom post types or hard-coded snippets. While we can offer website speed optimization recommendations, this excludes websites not built by Web V8.

9. Custom Websites & Support

For custom-coded websites, we provide technical consultation to you or your developer, but cannot offer hands-on support. Server customization requests can be submitted via tickets.

10. Pro & Premium Plugins

As 90% of these plugins or themes are developed by third parties we take no responsibility for the functionality or ongoing longetivity and dependency of the plugin(s). These addons are merely offered to clients for convenience not at a professional capacity. Transferring to another hosting provider will revoke your licensing and any permissions granted for the plugin(s).

11. Resource Usage & Hacking

Acceptable resource usage limits are in place. Short-term resource spikes (5-10 days) for development purposes might be permitted upon request.

In the event of a website hack, Web V8 reserves the right to make necessary security changes to your website. This may include theme changes, plugin modifications or removal, licensing updates, or overall updates. We will contact you regarding vulnerabilities detected within the website core.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. We reserve the right to modify these Terms for users in other Australian states to comply with local regulations.

13. Disclaimer of Warranties

Web V8 disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

Web V8 shall not be liable for any damages arising out of or related to your use of the Services, including but not limited to data loss, downtime, security breaches, or content removal.

15. Changes to Terms

Web V8 reserves the right to modify these Terms at any time. We will post any changes on our website.
